Coating Installation Warranty / Guarantee
The Porch Doctor takes tremendous pride in our Surfaces and do everything we can to provide a finish that will give you many years of service. As such our warranty typically starts at 5 years on concrete and 10 years on plywood. We do offer additional coverage if desired to extend the warranty period and provide an all-in-one coverage.
The Flexstone coatings waterproof membrane is guaranteed to be free from defects for a period of FIVE TO TEN (5-10) years and the application to be free from defects for a period of TWO (2) years from the date of installation. Client is responsible for maintaining and contacting the contractor after the first 5 years for an inspection. If the Flexstone system has been properly cleaned & maintained the warranty can be extended for a second term.
This Workmanship Warranty, and the Warranty on materials, will not be in effect until the contractor is paid in full including all outstanding invoices in full, including any extras.
The following shall not be considered to be the failure of the workmanship:
Faults in the conception of the work of faulty construction of the building
Modifications, transformations, additions or repairs to the areas after installation
All falling objects regardless of the source
Superior force or circumstances outside one’s control such as but not limited to, natural catastrophes
including floods, lightning, hail, earthquakes and wind
Poor maintenance of the waterproofed areas or failure to exercise reasonable care
The Owner shall give notice of any defect or leakage to the applicator within 48 hours from the discovery of the problem. If the Owner fails to give such notice, then the contractor shall not be responsible for any increased cost of repair or replacement that may result. The contractor shall not be liable for resulting interior damages.
Contractor agrees to repair defects in workmanship for the period of the warranty. If the problem relates to faulty material, there may be a labour charge applicable, plus a material charge for products not covered by warranty. Contractor has the first right of refusal to perform interior repairs & is not liable for work performed by others.
This warranty can be transferred to the subsequent owners of the building but only if a written notice is sent or emailed to contractor within Ten (10) days of this change. Without this notice, this warranty is void.
Contractor shall not be liable for any leakage due to negligence on the part of the Owner or his family, agents, tenants or employees. The surface requires regular maintenance twice a year to clear debris from drains, gutters.
The Owner agrees not to make any claim or take proceedings against any other person or corporation whatsoever arising from or in any way relating to the defect of workmanship and agrees not to make any claim or take proceedings against any other person or corporation who might claim contribution or indemnity under the provisions of any statute or otherwise.
The owner is presumed to understand the nature and scope of each clause of this warranty.
The owner must sign below and return to contractor within 30 days to execute & enforce this warranty. The laws of the province of Ontario shall govern any claims by the Owner against Contractor.
